WE GUARANTEE YOUR CONFIDENCE
These General Conditions, along with any Particular Conditions that may be established, regulate the legal relationship arising from the contracting processes formalized by WE ARE HONEST, S.L.U., and the users of its online platform provided through the Honesteditors.com website. These processes can be contracted by any user who complies with all the terms stipulated in these Conditions.
This document is available at all times for reading and printing on this website, allowing for download as per the R.D. 1906/1999, which regulates Telephone or Electronic Contracting, and Law 7/1996, on Retail Commerce (amended by Law 47/2000, of December 19), applicable to distance sales in articles 38 and following.

WE ARE HONEST, S.L.U. reserves the right to modify or change these conditions at any time. If the modifications constitute a substantial change in the terms, it will notify by publishing an announcement on our website.
Services are available only to individuals who are at least 18 years old. The use of any service after notification of a substantial change in the terms constitutes acceptance of the modified Terms.
ACCEPTANCE AND PROOF OF ACCEPTANCE
As a condition to complete any transaction on this platform, the user is obliged to register and accept these terms and conditions.
From the moment of acceptance, the user acquires the status of Honest Editors' Client.
CHARACTERISTICS OF THE OFFERED SERVICES
Honest Editors offers a professional photo editing service to professional photographers according to the guidelines provided by the client. Our services include optimizing exposure, temperature, contrast, and sharpness of images. We also perform cropping and other adjustments necessary to improve the visual quality of photographs, ensuring they are ready for delivery to clients. It is important to note that within our basic editing fee, we do not use spot removal or retouch skin in photographs.
Before submitting galleries for editing, photographers must register on our website through the "SIGN UP" section. During this process, they will be asked to provide their name, email address, and password. This data will be stored and managed using the Memberstack plugin from Webflow, ensuring the privacy and security of user information.
Creation of the Photographer's Private Web:
Once the photographer submits their registration details, they will receive a confirmation email, and their private web will be created within a maximum of 24 business hours. Access to this private web is done through the "LOG IN" section of our website, using the email and password provided during registration.
Sending Galleries and Payment Management:
From their private web, the photographer can submit their galleries for editing, check the status of galleries in progress, and download edited galleries once edited. They can also make the corresponding payment through our platform and download the invoice once the payment has been made.
File Submission and Gallery Reception Service:
We use a file submission service for photographers to attach their galleries from their dashboard. These galleries are received directly on our cloud-stored private server.
Gallery Assignment and Editing:
The gallery is assigned to one of our editors.
Editing Platform and Delivery of Edited Gallery:
Once the edited gallery has been reviewed and approved, an email is sent to the photographer with a link to download their finished gallery. Additionally, the photographer can access their dashboard to download the gallery from there.
POLICY ON PHOTOS TO BE UPLOADED
At "Honest Editors," we are committed to ensuring the quality and integrity of the photo galleries our editors process. To this end, we establish the following policies and guidelines for the photos users upload to our platform:
Allowed Types of Photos:
We accept photos of weddings, couples, families, newborns, as well as other types of events and similar photo sessions.
Quality of Photos:
Photos must have sufficient resolution and quality to allow effective editing. We reserve the right to reject photos that do not meet these minimum standards.
Acceptable Content:
All types of photos are allowed within legal and ethical limits. However, we reserve the right to reject any image that we consider inappropriate, offensive, illegal, or infringing on the rights of third parties.
Limitations and Prohibitions:
a. Photos containing violent, pornographic, discriminatory, defamatory, or illegal content are not allowed.
b. Photos infringing on the copyrights of third parties are not accepted. Users must own the necessary rights to the photos they upload to the platform.
c. Photos violating the privacy of individuals, such as images taken without consent in private places or showing clearly identifiable individuals without their consent, are not allowed.
d. Photos promoting or inciting hatred, violence, racism, discrimination, or any form of harmful or illegal behavior are not accepted.
e. Uploading photos containing watermarks or other trademarks, unless the user has the necessary rights to use them, is prohibited.
f. Photos containing sensitive personal information, such as identification numbers, physical or email addresses, phone numbers, etc., are not allowed.
Users who violate these policies may face disciplinary measures, including the removal of photos from the platform and the suspension or cancellation of their account. We reserve the right to modify these policies at any time and without notice to ensure the security and quality of our platform.
PHOTO TREATMENT POLICY
We commit to not using our clients' photos for marketing or promotional campaigns without their express consent. Additionally, we will not publish photos on any site without the prior consent of the client.
Confidentiality of Presets:
We guarantee absolute confidentiality of the presets each photographer uses to edit their photos. These settings are considered confidential information and will not be shared or used for any purpose without the explicit consent of the photographer.
DELIVERY TIME
Once we receive payment from the client, a confirmation message will be sent. This message will indicate the delivery time, which is set at a maximum of 7 business days from the moment the payment is made. We commit to meeting this deadline to ensure satisfaction and punctuality in the delivery of our photo editing services. In case of any exceptional delay due to excessive demand, we will communicate with the client to inform them of the situation and provide a new delivery estimate.
This delivery time may be extended in the case that the photographer sends two or more galleries at the same time, since his work will always be edited by the same editor of the team, and therefore we must finish editing a gallery before starting with the next one.
PAYMENT CONDITIONS AND METHODS
Once the gallery is received, a verification of the details is carried out, and a confirmation email is sent to the photographer. This email contains the gallery details, a link to Stripe for the corresponding payment, and the estimated delivery time. Once the payment is completed, a payment confirmation is sent to the photographer along with the attached invoice in PDF format.
Payment is always 100% in advance of the order and will be sent when we confirm the payment.
VALIDITY OF PRICES AND OFFERS
The products and services offered on the website, as well as their prices, will be available for purchase as long as they are in the product catalog displayed on the website. Users are advised to access updated versions of the website to avoid errors in prices. In any case, orders in process will maintain their conditions for 7 days from the moment of formalization.
RETURNS AND WITHDRAWAL OF PURCHASE
Withdrawal is the right of a consumer to return a product to the store within a legal period, without having to allege or explain any reasons and without suffering a penalty.
According to the Law on Information Society Services and Electronic Commerce (LSSI), the customer has the right to withdraw from an online service contract. However, this right may be limited in certain cases, such as when the service has already begun.
These withdrawal conditions apply to photo editing orders placed with Honest Editors.
Withdrawal before the start of the service:
The customer has the right to withdraw from the contract without any penalty before the editing of the photos begins.

Honest Editors will refund the customer the total amount of the order within 14 calendar days from the receipt of the withdrawal notification.
Withdrawal after the start of the service:
In general: According to Article 103 of the LSSI, the customer loses their right of withdrawal once the editing of the photos has begun.
Exceptions:
Technical issues: If the customer experiences technical issues with the service, they can request its interruption and a partial refund. The refund amount will be determined based on the work done up to the time of the interruption.
Errors by Honest Editors: If Honest Editors makes an error in editing the photos, the customer can request the correction of the error.
To request a refund in case of an exception, the customer must follow these steps:

Honest Editors will assess the request and communicate its decision to the customer within 14 calendar days.
General exceptions to the right of withdrawal:
Digital downloads: The right of withdrawal does not apply to digital downloads of image files.

In case of doubt, the customer can contact Honest Editors via email.
The maximum period to receive the refund is 14 natural days through the payment method used in the order. If, after this date, you have not received the amount of an accepted refund, please contact us via email at hello@honesteditors.com.
DISCOUNTS AND PROMOTIONS
Sometimes, we create codes for you to get a product with a significant discount.
To apply discounts, simply enter our online platform, choose the service to hire, and during the checkout process, you will have the option to include the promotional code before making the payment. Once entered, the discount will be applied immediately to the item.
It may also be that a promotional code means a reduction in the online purchase. In this case, by entering the code during the checkout process, it will be automatically applied to the entire purchase made.
APPLICABLE WARRANTIES TO PHOTO EDITING SERVICE
Satisfaction Guarantee:
Honest Editors commits to providing a high-quality photo editing service.
If the customer is not satisfied with the final result, they can request a free review of the work.
Quality Guarantee:
Honest Editors guarantees that edited photos will be free of technical defects and editing errors.
If any defect or error is detected, Honest Editors undertakes to correct it at no additional cost to the customer.
Confidentiality Guarantee:
Honest Editors commits to maintaining the confidentiality of all customer photos, editing instructions, and personal data.
Customer photos will not be used for any purpose other than the requested editing.
Security Guarantee:
Honest Editors uses security measures to protect customer photos and personal data.
Customers can access their photos and personal data at any time through their user account. For security reasons, one month after sending the edited gallery to the photographer, we delete that gallery from our system. Therefore, it is not possible to access the edited files or request a copy of them after 30 days from the upload of the edited gallery.
Limitations of Guarantees:
- Damages Caused by the Customer: We cannot be held responsible for damages to photos during the editing process if such damages result from actions or decisions made by the customer, such as sending low-quality or damaged files.
- Errors in Customer Instructions: We do not guarantee final results if errors or inconsistencies in editing are the result of instructions incorrectly provided by the customer. It is the customer's responsibility to provide clear and accurate instructions for the editing process.
- Delivery Delays due to External Circumstances: We cannot guarantee delivery times in cases of delays caused by circumstances beyond Honest Editors' control, such as technical issues, interruptions in internet service, natural disasters, or any other eventuality that may affect the ability to meet agreed-upon deadlines.
- General Exceptions and Additional Limitations: In exceptional cases, Honest Editors may offer alternative solutions or compensation at its own discretion to resolve any issues or dissatisfaction related to the photo editing service. These solutions will be subject to the individual assessment of each case and may include free re-edits, discounts on future services, or partial refunds.
COMPLAINTS OR SURCHARGES
The user can file complaints by sending an email to hello@honesteditors.com, indicating their name and surname, the gallery name, and its date, and explaining the reasons for their complaint.
The refund will be made within the next 14 natural days from the date we approve your refund.
ONLINE DISPUTE RESOLUTION PLATFORM
The European Commission has created an Online Dispute Resolution (ODR) platform to facilitate the out-of-court resolution of disputes between consumers and traders.
The ODR platform is available in all official EU languages and allows consumers to file a complaint against an online trader based in the EU.

Online dispute resolution procedure:
The online dispute resolution procedure is as follows:
- The consumer submits a complaint through the ODR platform.
- The ODR platform forwards the complaint to the trader.
- The trader has 14 days to respond to the complaint.
- If the trader does not respond to the complaint within 14 days, the ODR platform may initiate a dispute resolution procedure.
- The dispute resolution procedure may be mediation, arbitration, or conciliation.
- The decision of the mediator, arbitrator, or conciliator is binding on both parties.
- Online dispute resolution does not apply to all types of disputes.

LIMITATION OF LIABILITY
Honest Editors reserves the right to make, at any time and without prior notice, modifications and updates to the information contained on the website, its configuration and presentation, access conditions, contracting conditions, etc. Therefore, the USER must access updated versions of the page.
The user undertakes to immediately notify Honesteditors.com of any security breach on your portal.
Honest Editors will not be responsible for any loss arising from the misuse or unauthorized use of the website.
The user is solely responsible for maintaining the confidentiality of their password and solely responsible for all activities resulting from the use of their password on pages developed by Honest Editors.
The user agrees to hold Honest Editors harmless from any claims, losses, expenses, damages, and costs (including direct, incidental, consequential, punitive, exemplary, and indirect damages) and reasonable attorney's fees resulting from any breach by the user/buyer of these conditions, whether considered material or immaterial; the use or misuse of the Services by you or anyone acting on your behalf or using your account on Honesteditors.com, or any material or immaterial violation of any third-party rights, title, or interests.
Under no circumstances will Honest Editors be liable for any breach of contract on your part, negligence regarding the site, the service, or any content, for any loss of profits, loss of use, or actual, special, indirect, incidental, punitive, or consequential damages of any kind arising from your misuse of the tools provided.
Our only responsibility will be to supply the product on the terms and conditions expressed in this hiring policy. Honest Editors will not be responsible for any consequences, damage, or harm that may arise from the improper use of the supplied products.
LANGUAGE
The language in which the contract between HONEST EDITORS and the Customer will be perfected is English.
JURISDICTION AND APPLICABLE LAWS
These Terms of Use are governed by Spanish law. These Terms of Use are subject to the provisions of Law 7/1998 on General Contracting Conditions, Royal Legislative Decree 1/2007, on Consumers and Users, Royal Decree 1906/1999, which regulates Telephone or Electronic Contracting, Law 7/1996, on Retail Trade, and Law 34/2002, on Information Society Services and Electronic Commerce.
In accordance with Article 29 of Law 34/2002 of July 11, on Information Society Services and Electronic Commerce, contracts concluded electronically in which a consumer is involved as a party will be presumed to be concluded in the place where the consumer has his habitual residence.
Electronic contracts between businessmen or professionals and users will be presumed to be concluded in the place where the service provider is established. In the event of a dispute arising from these general conditions and for the resolution of conflicts, the parties submit, at their free choice, and waiving any other jurisdiction, to the courts and tribunals of the User's domicile.
